Welcome to RIFO. RIFO refers to the group of companies, RIFO Holding Group Inc., RIFO Fintech Group Inc, RIFO Realty Group Inc., RIFO Home Solution Group Inc., and RIFO Technologies Inc., and affiliated companies. By using the term "RIFO App", we refer to this Application and RIFO Technologies Inc. which owns and operates RIFO App.
These terms of service (the or these "Agent Terms") are an agreement between you, as a licensed real estate agent, and RIFO App regarding your use of the RIFO App, which includes information services provided through this Application (the "Services"), and specifically, regarding your use of the real estate agent platform accessed by licensed real estate agents through the RIFO App (the "Agent App"), whereby you provide information related to the buying and sale of real estate to RIFO App Users (collectively, with the Services, the "Agent Services"). These terms supplement and are in addition to RIFO App's General Terms of Use and RIFO App's Privacy Policy. By accessing or using the Agent App and/or the Agent Services, you agree to be bound by the Agent Terms, RIFO App's General Terms of Use, and RIFO App's Privacy Policy.
RIFO App reserves the right to change these Agent Terms at any time without any notice to anyone, and the updated Agent Terms will be posted to the RIFO App and to the portion of the RIFO website devoted to the RIFO App (the “Website”). It is your responsibility to periodically check these Agent Terms for changes. Your continued use of the Agent Services following the posting of changes to these Agent Terms on the RIFO App and the Website will mean you accept and agree to the changes. Provided you comply with these Agent Terms, RIFO App grants you a personal, non-exclusive, limited privilege to enter and use the Agent Services.
PLEASE READ THE ENTIRETY OF THESE AGENT TERMS BEFORE ACCESSING, USING, OR DOWNLOADING THE AGENT APP. THESE AGENT TERMS CONTAIN IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS, AS WELL AS CERTAIN EXCLUSIONS AND LIMITATIONS ON THOSE RIGHTS.
These Agent Terms are effective upon acceptance. When you register for an account with the Agent App, you accept these Agent Terms by checking the appropriate box and acknowledging you have read, understood, and accepted these Agent Terms.
Unless context otherwise requires, words importing singular include the plural and vice versa. RIFO App retains absolute and unfettered discretion where a provision of these Agent Terms so requires.
RIFO App offers services to you through the Agent App, including connecting you with Users, other real estate agents, and third-party vendors ("Vendors"). Users, Agents, and Vendors may access and use RIFO App's services through distinct platforms on the RIFO App specifically designed for users (the "User App"), Agents (through the Agent App), and Vendors (the "Vendor App").
For clarity, the RIFO App, includes the User App, Agent App, and Vendor App.
The Agent App is in part designed to enable you and RIFO Users to connect and arrange for the provision and receipt of the Agent Services. You understand and agree the Agent App is merely designed to facilitate connections and arrangements between you, Users, and Vendors and is not intended to, and does not, provide real estate or trading services as defined in the Real Estate Services Act SBC 2004, c 42.
A service request may be made by a User through the User App to you on the Agent App (the "Service Request") for services related to the Agent Services. The Service Request will contain a fully detailed and accurate description of the services requested.
RIFO makes no representation, warranty, or guarantee as to the availability, timing, or provision of any Service Request.
You may only use the Agent App provided you are a licensed real estate agent and have registered an account through the Agent App. In order to set-up an Agent App account (the "Agent Account") you must provide a valid email address and password created by you (the "Login Methods").
By setting up an Agent Account, you represent, warrant, and covenant to RIFO App that you: (i) will provide RIFO App with true, accurate, current, and complete information; (ii) will maintain and promptly update information you provide to RIFO App; and (iii) will not enter any irrelevant data into any form or data entry field on the Agent App other than the data requested by RIFO App for such field.
You are solely responsible for (i) the confidentiality and security of your Login Methods; and (ii) all activities that occur under your Login Methods and/or your Agent Account.
RIFO App reserves the right to reject any registration of an Agent Account in RIFO App’s sole discretion. In addition, in the event you provide, or RIFO App reasonably suspects, you have provided any information that is untrue, inaccurate, not current, or incomplete, then RIFO App has the right to suspend or terminate your Agent Account and refuse any and all current or future use of the Agent App. RIFO App is not obligated to inquire as to the authority or propriety of any use of, or action taken under, your Login Methods and/or your Agent Account. RIFO App is not responsible or liable for any loss to you that arises from any use of your Agent Account or Login Methods.
Subject to the terms and conditions of these Agent Terms, RIFO App grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable, personal, non- commercial, right to download, install, and use the Agent App on your mobile device.
The license is subject to: (i) your compliance with these Agent Terms; (ii) and compliance with any other rules, procedures, policies, terms, or conditions that govern all or any portion of the Agent App; and (iii) compliance with any additional requirements, restrictions, or limitations provided by RIFO App or any applicable third-party.
RIFO App expressly reserves all rights and remedies not expressly granted in these Agent Terms.
You expressly agree, represent, warrant, and covenant to RIFO App you will abide by and not violate RIFO App's General Terms of Use:
In addition to RIFO App's General Terms of Use, you represent, warrant, and covenant to RIFO App you will not do any of the following in connection with the Agent Services:
RIFO App welcomes hyperlinks to the homepage of an Agent's website and/or other personal social media. You may only establish a hyperlink to the homepage of your website if: (i) the link does not state or imply any affiliation, connection, sponsorship, endorsement, commercial tie-in, or approval of your site by RIFO or the RIFO App or anyone having rights to any content, or create the false appearance that an entity is affiliated with or sponsored by RIFO or the RIFO App; and (ii) the appearance, position, and other aspects of the hyperlink does not damage or dilute the goodwill affiliated with RIFO App, its trademarks, or any other trademarks appearing on or in the Agent App.
RIFO App does not permit framing or inline linking to any other website, service, or application.
